YOU ARE BEING PRESENTED THIS AGREEMENT FOR ACCEPTANCE VIA Fynbos Technologies LLC. (THE “MARKETING PARTNER”). MARKETING PARTNER IS NOT THE SUPPLIER OF SERVICES DESCRIBED IN THIS AGREEMENT, THE PAYMENTS PROVIDER IDENTIFIED BELOW AND MACHNET ARE THE SUPPLIER OF SUCH SERVICES. MARKETING PARTNER DOES NOT PROVIDE ANY FINANCIAL SERVICES.
Machnet Technologies Inc. (“Machnet”) values consumer privacy as a high priority. This privacy policy (“Privacy Policy”) applies to all of Machnet’s services including its website https://www.machnetinc.com/. Machnet’s Third Party Servicers have their own privacy policies that are separate from ours, and govern the Third Party Servicers’ personal information and data practices. Any terms that are not defined in this Privacy Policy have the meanings pursuant to the Machnet Terms of Use (“User Agreement”), incorporated herein by reference. Please read this Privacy Policy prior to your start of using the Services.
This Privacy Policy may be updated from time to time. Please review the Privacy Policy regularly for any changes. If you continue to use the Services 30 days after a change to this Privacy Policy, it is understood that you accept and agree to any and all changes.
This Privacy Policy explains policies covering Personal Information and non-personal information collected by us to inform you as to how your own information is collected and used.
Machnet provides limited access to your Personal Information to only those employees of Machnet and its Third Party Servicers who need it to fulfill their responsibilities to provide the Services to you. Employees must adhere to our strict data protection and other policies. Employees violating these policies will be subject to disciplinary action, up to and including dismissal. We employ appropriate measures to protect your information against unauthorized access, disclosure, alteration or destruction. These may include, among others, encryption, physical access security and other appropriate technologies. Machnet continually reviews and enhances its security systems as necessary.
COLLECTION OF INFORMATION:
Machnet collects personal and non-personal information in order to offer or provide our Services to you. “Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular identifiable person or household. The Personal Information collected, directly or indirectly, may include the following: your name, address, telephone number, date of birth, social security number, government-issued identification (i.e. driver’s license or passport) number, bank account information and details and debit/credit card details. We also collect information regarding your Recipient, including, but not limited to their name, address, phone number, bank account details, ID copies, location of receipt of funds and amounts received. Personal Information we collect and the sources of such Personal Information include the following:
a. We collect Personal Information when you create an account, ask our Payments Providers to send or receive money or ask us to provide other goods or services, provided by telephone, online at our Website, through paper-based forms or at various agent locations. This Personal Information may include the identities and contact information of senders and recipients of money transfers or payments, Debit/credit card, banking or other billing information, birth dates and other personal identifiers, “out of wallet” questions used to verify your identity for security and fraud prevention purposes, identification number and amounts paid or transferred.
b. We collect Personal Information when you submit Personal Information on applications or other forms to us or our Third Party Servicers, including in connection with sending and receiving money transfers carried out by our Payment Providers, through your enrollment and participation in loyalty programs and when you provide additional information we may reasonably request for fraud prevention purposes.
c. In case your mode of payment is ACH Pull, we collect information relating to your bank account such as account number and routing number which are obtained during the process of your bank account verification. Such bank account verification is completed by Machnet using the services of its Third Party Servicers.
d. In case your mode of payment is debit card, we collect information relating to your debit card for verification purposes but such information is not stored at our end.
e. We collect information about your transactions with our Payment Providers, including transaction history, such as frequency of use and amounts transferred.
f. In connection with identity verification, fraud prevention and similar security purposes, we collect and/or confirm certain identity-related information, financial background and similar information through third parties sources such as our business customers, government agencies and consumer reporting agencies;
g. We collect information regarding your online activity as described in the section below titled “INTERNET TECHNOLOGY.”
h. We may collect Personal Information otherwise with your consent or as permitted or required by law.
We processes and store Personal Information collected from you via your use of the Service or where you have given your consent, including but not limited to website, emails, survey forms, referral programs, third party services used for (but not limited to):
a. identity verification service,
b. financial background information describing financial status,
c. Identification information, such as name and address data,
d. Transaction information, such as account activity, debit activity or credit activity,
e. Other information relating to financial matters.
LOGIN USING FACEBOOK AND GOOGLE:
Machnet also allows you to login using Facebook and Google accounts. If you so connect to Facebook and Google, they will ask your permission to share certain information from your Facebook and Google account with Machnet, including your first name, last name, public profile, friend list, email address, birthday, hometown and current city and friends’ hometown and current cities, and whether you “like” Machnet page on Facebook. This information is collected by Facebook and Google and is provided to us under the terms of Facebook’s and Google’s privacy policy. You may control the information that we receive from Facebook and Google using the privacy settings in your Facebook and Google account.
SHARING YOUR PERSONAL DATA WITH THIRD PARTIES:
Machnet shares your Personal Information and non-personal information with its Third Party Servicers or other third-party service providers for the following purposes:
a. To process your Transactions;
b. To verify your identity;
c. To collect payment for your use of the Service;
d. To allow our partners and Third Party Servicers to fulfill their promotional obligations to you;
e. To troubleshoot problems with the Service;
f. To comply with applicable laws, regulations, and rules, such as those relating to “know-your-customer” and anti-money laundering requirements;
g. To detect and prevent fraud and other illegal uses of the Service;
h. To send you marketing notices, service updates, and promotional offers; and
i. To contact you by telephone including but not limited to auto-dialed or pre-recorded message calls or text (SMS) messages (if applicable) as authorized for the purposes described in this Privacy Policy.
USE OF COOKIES AND WEB BEACONS:
A “cookie” is a small text file placed on your device by a web server you visit and which is acknowledged by your web browser. A cookie contains information on you that your browser saves and sends back to a website when you visit it again. “Web beacons” are transparent electronic images placed in the web code, also called “clear GIFs” or “Web bugs.” We use cookies and/or web beacons for a variety of purposes, including, but not limited to, the following: (a) to assist us in providing our Services to you; (b) to allow you to change pages during your visit to our website without repeatedly having to re-enter your password; (c) to track activity on our website; (d) to determine whether you came to our site from a banner ad, affiliate or a Third Party Servicer website; (e) To display our ads to you when you visit other websites; or (f) To allow third-party vendors including but not limited to Google, to show our ads to you on sites across the internet based on your past visits to our website. You can adjust settings in your browser that allow you to elect to accept cookies or to have your browser notify you each time a cookie is offered. You can also delete cookies from your devices. Instructions on how to accept cookies, on how to be notified that a cookie is being offered and on how to delete cookies are available through your Internet browser. You can also visit the Google Ads Preference Manager, and Network Advertising Initiative opt-out page to opt-out of third-party cookies.
DISCLOSURE OF INFORMATION:
Machnet does not sell, distribute, or otherwise disclose your information to third parties without first obtaining your express written consent and giving you an opportunity to opt-out of such disclosure, except as expressly specified in this Privacy Policy. There are some disclosures to third parties that are not subject to the opt-out, such as the following: disclosures necessary to affect, administer or enforce a transaction requested by you; to companies that perform services for us; and/or to prevent fraud. If you participate in any referral programs, your information may be disclosed as specified in the terms of the program. Additionally, Machnet may disclose information about former consumers or customers to Third Party Servicers and companies with which Machnet is affiliated. Those disclosures may consist of the following: (a) financial background information describing financial status; (b) identification information, such as name and address data; (c) transaction information, such as account activity, debit activity or credit activity; and (d) other information relating to financial matters.
RECIPIENTS OF INFORMATION:
Machnet may disclose your information to its Third Party Servicers and other third party service providers. These recipients include: (a) Payment Providers, financial institutions such as banks, credit card companies, brokerage houses, and consumer reporting agencies pursuant to the Fair Credit Reporting Act (15 U.S.C. §1681 et seq.); (b) companies that process transactions or provide other services for us including, but not limited to, attorneys, accountants, and auditors; and (c) government and law enforcement agencies in general and where specifically required or permitted under the Right to Financial Privacy Act of 1978 (12 U.S.C. §3401, et seq.), to comply with federal, state, or local laws, rules, and other applicable legal requirements, as required by Title III of the federal United and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 (USA Patriot Act; P.L. 107-56).
DELETION OF ACCOUNT
Upon your request for deletion of your account, we will process the request and delete your account along with all of your records and information regarding your Personal Information and transactions. In accordance with Federal and State regulations pertaining to money transfers carried out by our Payments Providers, we will retain your records in archive to adhere with record keeping obligations. We will only utilize the archive for limited purposes such as to fulfill our regulatory obligations or to adhere to any request from a regulatory body having jurisdiction over our activities.
INTERNATIONAL USERS
Our services are intended for United States residents only. Personal information of Recipients may include Personal Information of non-US persons, and such persons should be aware that their information is being collected and processed in the United States or Canada where our servers are located. The United States and Canada may not have the same data protection laws which a foreign country may have. The collection, use and disclosure of Personal Information of non-US persons shall be in accordance with US law and this Privacy Policy.
CALIFORNIA RESIDENTS
California law requires that California residents are given a comprehensive description of our practices regarding the collection, use, disclosure and sale of their Personal Information. This section only applies to our collection and use of Personal Information of California residents. For requests relating to the collection and use of Personal Information by our Third Party Servicers, please consult such third parties directly. We collect and use Personal Information as described in this Privacy Policy.
We agree to comply with applicable data protection laws and shall instruct our employees and agents to comply with the applicable data protection laws, as well as the terms of the Terms of Use with respect to your Personal Information.
Your rights include the right to request that we disclose what Personal Information we have collected about you in the past 12 months preceding the request. This may include: (i)specific pieces of Personal Information we have collected about you; (ii)categories of Personal Information that was collected; (iii) categories of the sources from which Personal Information was collected about you; (iv) categories of Personal Information that was sold or disclosed for business purposes about you, as applicable; (v) categories of third parties to whom the Personal Information was sold or disclosed for business purposes, as applicable; (vi) the business purposes for collecting, or selling Personal Information, as applicable.
You have the right to request that we delete the Personal Information about you that we have collected. Under California law, we are not required to comply with such a request if we are obligated to maintain the Personal Information to comply with our legal obligations, to provide you the Services, detect security incidents, or otherwise use the Personal Information in a lawful manner in relation to the purpose to which the Personal Information was provided to us.

Requests for deletion may require us to verify your identity which may include the collection of other Personal Information.
We do not sell Personal Information as defined in California Law. We do not discriminate against California residents who exercise their data protection and deletion rights under California law.
MINORS
Our services are prohibited for persons under the age of 18. We do not knowingly collect, use or sell Personal Information of persons under the age of 18 years old. If you believe that we have collected Personal Information of a person under the age of 18, please contact us.

Machnet may create links to third party websites. Machnet is not responsible for the content or privacy practices employed by websites that are linked from our website.
